End User License Agreement (EULA)

This End User License Agreement (“Agreement”) is a legal agreement between you (“User” or “you”) and OnlyPlates, Inc. (“OnlyPlates,” “we,” “us,” or “our”), governing your use of the OnlyPlates mobile application (“App”). By downloading, installing, or using the App, you agree to be bound by the terms of this Agreement. If you do not agree to these terms, do not use the App.

1. License Grant

OnlyPlates grants you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes, subject to the terms and conditions of this Agreement.

2. User-Generated Content

a. Content Standards: You agree not to submit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable. This includes, but is not limited to, content that is offensive, insensitive, upsetting, intended to disgust, in exceptionally poor taste, or just plain creepy.

b. Filtering: OnlyPlates filters and moderates user-generated content to the best of our ability. While we strive to ensure the accuracy and efficacy of these methods, no system is entirely foolproof.

c. Flagging and Reporting Mechanism: The App includes a feature that allows users to flag content they believe violates our standards. Flagged content will be reviewed by our moderation team within 24 hours, and appropriate action will be taken if necessary.

d. Blocking Users: The App provides users with the ability to block other users who engage in abusive behavior. Blocked users will not be able to interact with you through the App.

f. Prohibited Content: The following types of content are strictly prohibited:

Defamatory, discriminatory, or mean-spirited content, including references or commentary about religion, race, sexual orientation, gender, national/ethnic origin, or other targeted groups.
Realistic portrayals of people or animals being killed, maimed, tortured, or abused, or content that encourages violence.
Depictions that encourage illegal or reckless use of weapons and dangerous objects.
Overtly sexual or pornographic material.
Inflammatory religious commentary or inaccurate or misleading quotations of religious texts.
Harmful concepts capitalizing on recent or current events, such as violent conflicts, terrorist attacks, and epidemics.
Spam or unauthorized marketing content, including unsolicited promotional materials, advertisements, or any form of commercial solicitation.
Any and all non-food related content. Content that is not related to food may be reported and removed at the discretion of OnlyPlates.

3. User Conduct

You agree to use the App only for lawful purposes and in a manner consistent with all applicable laws and regulations. You must not use the App in any way that could damage, disable, overburden, or impair our servers or networks.

4. No Tolerance for Objectionable Content

OnlyPlates maintains a strict zero-tolerance policy for objectionable content. This includes but is not limited to content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable. Content that is offensive, insensitive, upsetting, intended to disgust, in exceptionally poor taste, or just plain creepy is also prohibited. Violators will face immediate account suspension or termination, and all objectionable content will be promptly removed.

6. Termination

OnlyPlates reserves the right to terminate your access to the App at any time, without notice, for any reason, including but not limited to a breach of this Agreement.

7. Disclaimer of Warranties

The App is provided “as is” and “as available,” without warranty of any kind. OnlyPlates disclaims all warranties, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of Liability

To the fullest extent permitted by law, OnlyPlates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the App.

9. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Arkansas, without regard to its conflict of laws principles.

10. Changes to this Agreement

OnlyPlates reserves the right to modify this Agreement at any time. We will notify you of any changes by posting the new Agreement on the App. Your continued use of the App following the posting of changes will constitute your acceptance of such changes.

12. Compliance with Apple’s Guidelines

a. Safety: We strive to ensure that the App is safe to use and does not contain content that could cause physical harm, damage to devices, or upset or offend users.

b. Data Security: We implement appropriate security measures to ensure the proper handling of user information and prevent its unauthorized use, disclosure, or access by third parties.

c. Reporting Criminal Activity: If your app involves reporting alleged criminal activity, it must involve local law enforcement and can only be offered in countries or regions where such involvement is active.

By using the OnlyPlates app, you acknowledge that you have read, understood, and agree to be bound by this End User License Agreement.
